Arbitration

Arbitration is a formal method of alternative dispute resolution (ADR). In this process, parties involved in a dispute work out their issues without going to court. An impartial third party, known as an arbitrator, is chosen to listen to the case. Similar to a trial, both sides present testimony and evidence. However, unlike a court trial, the arbitrator's decision is usually final and binding. There are two types of arbitration: mandatory (ordered by the court) and voluntary (agreed upon by the parties). Finding qualified arbitrators can be done through local attorneys, bar associations, or organizations like the American Arbitration Association. Examples of cases settled through arbitration include the Midwest Airlines flight attendants' contract dispute after Republic Airways Holdings' purchase of Midwest Airlines in 2009. In summary, arbitration provides an efficient alternative to traditional litigation, allowing parties to resolve disputes with the help of a neutral third party.
